I was referring to the transfer of data without a BAA in place as I have worked on this problem in relation to opening up the lines of communication between doctors and personal trainers on behalf of clients. In most cases, it has been the circumstance that doctors are unwilling to provided (or transfer) any patient data even if the data is requested to be transferred by the patient themselves.
